Social Media Terms Of Use

These social media terms of use (“SMTOU”) apply to you when you communicate with iGaming Ontario (iGaming Ontario” “us”, “we”, “our”) through social media.  By communicating with us, you agree to these terms.  Some accounts may have further terms of use, please ensure you read the bio of each account for further information.  

The social media provider’s respective terms of use also apply to communications to iGaming Ontario social media accounts.  You should carefully read these SMTOU as well as the terms of use of social media providers prior to using such services and communicating with iGaming Ontario

We reserve the right to supplement, remove, or modify these SMTOU at any time and from time to time without notice.  Please check regularly for changes.  

Posts, responding and messages

The frequency and content of our posts, responses and messages on our social media accounts will vary, but typically we will publish content and respond to messages during weekdays.  We will review tweets, posts and messages, but cannot commit to replying to, or moderating all discussions.  For clarity, this does not impose an obligation on iGaming Ontario to do so. In some cases, we may not respond to public replies or direct/private messages.  

By contacting us through social media, you acknowledge that any response we provide is intended to provide information but is not to be considered definitive advice or a final resolution of an issue.

Monitoring

iGaming Ontario typically monitors its social media accounts during regular business hours, which are X, Instagram & LinkedIn. Social media accounts will not be monitored during statutory holidays. The views expressed by others represent their views and are not endorsed or approved by us, nor do we endorse or approve any activities of other users. 

We reserve the right to remove, edit or move content that you post on our social media at any time in our sole discretion that does not comply with these TOU or which is otherwise objectionable according to commonly accepted community standards. 

Blocking, muting, reporting

We encourage positive discussions but acknowledge disagreements and constructive discussions are also common. However, the following messages or content are expressly prohibited:

• racist, hateful, sexist, homophobic, profane, vulgar, slanderous, insulting, defamatory, or harmful;
• aggressive, coarse, violent, life-threatening or incite violence, hatred, bigotry, or physical harm;
• offensive to community standards, obscene, pornographic or otherwise rude in tone or otherwise abusive;
• infringe the intellectual property rights of iGaming Ontario or any other third party or otherwise posted without properly obtained rights or consent;
• repetitive, spamming, deceptive, or malicious;
• disclose the confidential information or personal information of another party without the consent of such party;
• unsolicited advertisements, “junk mail”, “spam”,  “pyramid schemes” or any other form of solicitation or marketing; or
• otherwise contrary or in breach of the terms of use of the social media provider. 

We reserve the right to block, mute, and report users that post the prohibited content listed above.  

Endorsements

Where iGaming Ontario’s social media account follows another account or includes another account in a group or list, this is not to be taken as an endorsement of such account.  Any message that is retweeted, quote tweeted, favorited or book marked is also not to be taken as an endorsement of such message or the account. 

Privacy

iGaming Ontario does not have control over the social media channel and as such we have no responsibility or liability for how personal information is collected, used, disclosed, secured or treated by the social media provider (or any other third party).  

All content and information posted on iGaming Ontario social media pages, posts and accounts are publicly available and visible to the public (subject to privacy settings).  To protect yourself and your privacy, do not post any personal, private or confidential information on social media. This includes the personal information of any third parties without their consent.  All information posted on social media is at your sole risk.  

By sending tweets or messages to iGaming Ontario, you are consenting to the collection of your personal information by iGaming Ontario. To the extent that we collect your personal information, we will handle it in accordance with our Privacy Policy, which is incorporated here by reference.  In particular, we will cooperate with law enforcement officials and comply with any court order with respect to any claim or investigation due to any content posted.  

Warranty disclaimer

Any use or reliance of our social media accounts and any content, messages or materials posted by iGaming Ontario social media accounts is at your own risk.  The social media accounts content is provided “as is”.  We do not represent or warrant that our content will be uninterrupted, error free, correct, accurate, timely, reliable or appropriate. We do not make, and expressly disclaim, any representations, warranties, covenants and conditions, express or implied, arising out of operation of law, course of performance, course of dealing, usage of trade or otherwise, including any express or implied warranties and conditions of: merchantability, merchantable quality,  fitness for a particular purpose, non-infringement, safety, quality, freedom from defects or that defects will be corrected, uninterrupted, virus-free or error-free use of our social media site, or accuracy, currency, reliability, completeness or appropriateness relating to the content of them. You should not rely on the iGaming Ontario social media account for legal, financial or medical advice nor as authoritative in your particular circumstances.

Limitation of liability 

iGaming Ontario and its employees, agents and independent contractors shall not be responsible or liable for any damages, whether direct, indirect, incidental, special, consequential, or other in any way arising out of or in connection with iGaming Ontario social media accounts, including its content.
